Culture Hosts Clusters – General data sharing terms and conditions:
We are Culture Hosts – a trading name of Creative Tourist Limited (a company limited by guarantee with number 07980292) which has a registered office at c/o The Accounts Company, First Floor, 2 City Approach, Albert Street, Eccles, England, M30 0BL (“Culture Hosts”, “we” and “our”).
These general data sharing terms and conditions (the “Terms”) outline the basic information which is relevant to all types of contributors and users within any Cluster (as defined below). These Terms are specifically for members of organisations that belong to an approved Cluster. Each Cluster is managed by a Cluster Manager. You agree to promptly comply with all reasonable instructions provided to you by Culture Hosts and/or your Cluster Manager.
In consideration of our provision to you of membership and access to the Cluster, we each agree to comply with these Terms.
We define a Cluster as a custom ‘microsite’ published under culturehosts.co.uk. Please refer to our Service Level Agreement (the “SLA”) for more details.
Culture Hosts requires all members of each Cluster to agree to these Terms before activation of their membership can commence. These Terms will apply fully for the duration of your membership of any Cluster.
About Culture Hosts
Culture Hosts provide a digital platform designed to support collaborative working and help make the most of cultural assets by sharing information about events, venues, and organisations.
Culture Hosts is owned and operated by Creative Tourist Limited.
Creative Tourist’s Culture Hosts platform consists of four main elements (for further details on each element, please refer to the SLA):
- Data Warehouse
- Outbound API (documented here)
- Inbound API connections
How we gather data from your Cluster
Culture Hosts gathers information (referred to as ‘data’) from contributors and users manually via online, password-protected web forms on culturehosts.co.uk (e.g. ‘add a venue’, ‘add an event’) . Where a direct connection has been established to Culture Hosts from contributors’ or users’ own data management systems (e.g. box office systems or content management systems), this data may also be gathered automatically.
Your Cluster Manager is responsible for administering access/administrative permissions for all contributors and users.
Contributors and users in this context are museums, galleries, archives, libraries, heritage sites, music venues, stately homes and other cultural organisations and venues. They may also be independent event promoters, accommodation providers, shops or shopping centres, food establishments, or other consumer-facing businesses. Approved agents working on behalf of organisations or businesses may also be registered as contributors or users.
The Cluster website will provide a separate space for contributors and users who belong to that Cluster to view both confirmed and unconfirmed events — with unconfirmed events generally being made visible only to members of the contributing user’s Cluster. The Cluster website will also allow contributors and users to hold conversations, and share resources. This provides your Cluster with a relatively ‘private’ online space for collaboration.
When your organisation, venue or event data is stored in the Culture Hosts data warehouse and is set as confirmed, it is available to any other Cluster/publisher to view and distribute.
Whose responsibility is it to ensure data is accurate and up to date?
The accuracy of all content uploaded by contributors and users to our website at CultureHosts.co.uk (“Content”) is your sole responsibility. Culture Hosts accepts no responsibility for the accuracy of any Content input by contributors and users, including by individuals acting on your behalf.
It is your sole responsibility to ensure that the Content entered into the Culture Hosts system does not infringe any applicable laws, regulations or third party rights (including material which is obscene, indecent, pornographic, seditious, offensive, defamatory, threatening, liable to incite racial hatred, menacing, blasphemous or in breach of any third party Intellectual Property Rights) (“Inappropriate Content”).
By entering Content into the Culture Hosts system, you agree to accept and assume automatic responsibility for any copyright dispute arising from data entered by you or individuals acting on your behalf.
You agree to indemnify Culture Hosts against all damages, losses and expenses arising as a result of any action or claim that the Content constitutes Inappropriate Content.
Where the Content you enter into the Culture Hosts system contains any Personal Data (as defined below) you will ensure that you have all necessary appropriate consents and notices in place to enable lawful transfer of the Personal Data to Culture Hosts for the purposes of this agreement.
Please note that if you fail to comply with these Terms and post Inappropriate Content then this will constitute a material breach of the Terms upon which you are permitted to use CultureHosts.co.uk, and may result in our taking all or any of the following actions:
(a) Immediate, temporary or permanent withdrawal of your right to use CultureHosts.co.uk;
(b) Immediate, temporary or permanent removal of any Content uploaded by you to CultureHosts.co.uk;
(c) Issue of a warning to you;
(d) Legal proceedings against you for reimbursement of all costs resulting from the breach; and/or
(e) Further legal action against you.
By setting your Content as confirmed within Culture Hosts you, and/or any individual acting on your behalf, grant Culture Hosts full permission to openly publish and distribute all of that Content in any way it sees fit, in any context, in perpetuity. Culture Hosts pledges to do this appropriately and within the boundaries set out in these Terms.
Culture Hosts accepts no liability or responsibility (at any stage) for any Content entered into Culture Hosts which is then amended/withdrawn by any publisher after it has already been incorporated into other third party services.
Creative Tourist has the right to publish all confirmed Content entered by you into Culture Hosts onto its own website at creativetourist.com, as well as to any partner sites that use Creative Tourist’s publishing system. Creative Tourist will also make Content available for reuse and re-publication via a range of electronic data feeds that will be managed and administered by Creative Tourist (see outbound API details referenced in your SLA).
The explicit purpose of these data feeds is to allow the public and other publishers to build the Content into their own services and systems beyond the Culture Hosts website. This is ultimately to help drive and develop interest and knowledge of the cultural and tourism offer events, venues, and organisations, pushing out high quality, structured information accessible to the largest number of people online.
What data is available for reuse and re-publication?
Culture Hosts collects different types of Content from its contributors and users, which can be viewed when set as confirmed, to reuse and re-publish.
Data collected via Culture Hosts is categorised as either:
- Event information
- Venue information
- Organisation information
Which might consist of the following:
- Contact details (public enquiry numbers and email addresses)
- Facilities (e.g. café, shop, disabled access)
- Websites (URLs and descriptions)
- Representative image/photograph of the venue, or event
Data sharing etiquette
By activating your Culture Hosts Cluster you agree that you (including any individual acting on your behalf) shall not interfere with or disrupt (or attempt to interfere with or disrupt) the Culture Hosts service or servers or networks connected to this service, or to disobey any requirements, procedures, policies or regulations of networks connected to our service; or provide any public information to Culture Hosts that is false or misleading or that you do not have the right to disclose.
If you are at all unsure as to the suitability of any Content you are uploading to Culture Hosts or extracting from our database then please contact your Cluster manager or the Culture Hosts team for advice.
Amendment of the Terms
Culture Hosts reserves the right to amend these Terms from time to time at our sole discretion. The Cluster manager will be notified of any material changes to these Terms (and the effective date of such changes) by email.
Intellectual Property Rights: any and all copyright, database rights, design rights, domain name rights, patents, trade marks and all other intellectual property rights whether registered or not, and applications for such rights.
Personal Data: has the meaning set out in all applicable data protection and privacy legislation in force from time to time in the UK including the General Data Protection Regulation ((EU) 2016/679); the Data Protection Act 2018; the Privacy and Electronic Communications Directive 2002/58/EC (as updated by Directive 2009/136/EC) and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended.
